New EB-5 Proposal Introduces Major Changes for Investor Visas
The Department of Homeland Security has proposed new EB-5 regulations that largely formalize the 2022 Reform and Integrity Act while introducing additional guidance. The proposal includes a new $1.4 million investment threshold for High Employment Areas, clearer rules on eligible capital, redeployment, and investor compliance. DHS is accepting public comments for 60 days before finalizing the regulations, making this an important update for future EB-5 investors and Regional Centers.
Supreme Court Reaffirms Birthright Citizenship Under the Constitution
The U.S. Supreme Court ruled that children born on American soil remain entitled to birthright citizenship under the Fourteenth Amendment, rejecting President Trump's executive order seeking to limit the policy. The majority relied on longstanding constitutional precedent, including the landmark Wong Kim Ark decision, reinforcing that citizenship by birth remains protected except in very limited circumstances such as children of foreign diplomats.
